EVE AI AB – GENERAL TERMS AND CONDITIONS (UK & INTERNATIONAL)

1. INTRODUCTION

These General Terms and Conditions ("Terms") govern your access to and use of the mobile application eve and its AI- d r i v e n matching service ("the Service"), operated by eve AI AB, reg. no. 559553-7555 ("Eve", "we", "us", or "our").

By creating an account, downloading the app, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. ELIGIBILITY AND ACCOUNT

2.1 Eligibility

To use our Service, you must:

  • Be at least 18 years old.

  • Have the legal capacity to enter into binding agreements.

  • Not be prohibited by applicable law from using the Service.

  • Not have been convicted of a sexual offense or any crime of violence.

  • Not have been previously suspended or removed from the Service by us.

2.2 Account Responsibility

You agree to:

  • Provide accurate, current, and complete information about yourself.

  • Maintain the strict security and confidentiality of your login credentials.

  • Add at least one photo that clearly shows your face (intentional misrepresentation or "catfishing" is strictly prohibited).

2.3 Prohibited Behavior

You may not:

  • Misrepresent your identity, characteristics, or age.

  • Use the Service for any commercial or unauthorized business purposes.

  • Harass, bully, stalk, or harm other users.

  • Engage in habitual "ghosting," as this negatively impacts the platform's ecosystem and user experience.

3. THE SERVICE AND AI DISCLAIMER

3.1 AI-Driven Functionality

Eve uses Artificial Intelligence algorithms to interpret your personality inputs and generate/present your profile representation.

  • Automated Generation: You acknowledge and agree that interpretations made by the AI are fully automated and based directly on the data you provide.

  • Right to Edit: If you are dissatisfied with the AI's presentation or stylistic choices, your sole remedy is to edit your responses within the application to guide the AI toward a more accurate representation.

  • No Liability: eve AI AB is not responsible for any automated misinterpretations, inaccuracies, or stylistic choices made by the AI. By maintaining and displaying AI-generated content on your public profile, you accept it as your own representation.

3.2 Beta Status

You acknowledge that the Service is currently in a "Beta" stage. The Service may contain bugs, experience temporary interruptions, or produce unexpected results. We do not guarantee specific uptime or error-free functionality during this phase.

4. CONTENT AND DATA USAGE

4.1 License and AI Training

By using the Service, you grant Eve a non-exclusive, royalty-free, worldwide license to use your content to operate and deliver the Service. Important: You expressly consent to our use of your anonymized activity data, interactions, and inputs to train, fine-tune, and improve our AI algorithms.

4.2 Reporting

We take strict measures against copyright infringement, safety violations, and inappropriate content. Please report any violations immediately to: mio@eveai.app.

5. SUBSCRIPTIONS AND PAYMENTS (EVE+)

5.1 eve+

We offer a premium subscription service called "eve+". By signing up for this subscription, you agree to pay the fees indicated within the app.

5.2 Pricing

The subscription price for eve+ is displayed within the application prior to purchase in your local currency (e.g., GBP for UK users). Prices include all applicable local taxes (including UK VAT where applicable). We reserve the right to adjust pricing in the future, which will be communicated to you in advance.

5.3 Payment and Renewal

Payment is processed via the Apple App Store or Google Play Store ("Third-Party Platforms").

  • Subscriptions renew automatically every week (7-day periods) unless canceled at least 24 hours before the end of the current billing period.

  • Payment will be charged to your account on the respective Third-Party Platform upon confirmation of purchase.

5.4 Cancellation

You may cancel your subscription at any time through the subscription management settings of your Third-Party Platform. You will retain access to eve+ premium features until the end of the current paid period.

5.5 Statutory Cancellation Rights & Refunds (UK/EU Cooling-off Period)

  • Under UK and EU consumer laws, you normally have a statutory right to cancel a digital purchase within 14 days (a "cooling-off period").

  • Waiver of Coooling-off Right: By purchasing eve+ and choosing to immediately access and use the premium features, you expressly request the immediate commencement of the service and acknowledge that you thereby lose your statutory right to cancel and claim a refund.

  • We do not offer refunds or credits for partially used, unused, or remaining days of a weekly subscription period.

6. SAFETY AND OFFLINE MEETINGS

6.1 Risk Assumption

Eve does not conduct criminal background checks or identity verification screenings on its users. You interact with other users entirely at your own risk. Always prioritize your personal safety: meet in well-lit, public places, inform a friend of your plans, and trust your instincts.

7. TERMINATION AND SUSPENSION

We reserve the right to immediately suspend, restrict, or terminate your account without notice if you violate these Terms, are reported for inappropriate behavior, or are reasonably deemed to be a false profile, bot, or scammer. In the event of termination due to a breach of these Terms, no refunds for remaining subscription time will be issued.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law:

  • The Service is provided on an "as is" and "as available" basis.

  • eve AI AB is not liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service or the conduct of other users.

  • Consumer Rights: Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be lawfully limited or excluded under applicable local law (including the UK Consumer Rights Act 2015).

  • Our total liability to you for any claim arising out of these Terms shall not exceed £1,000 or the total amount you have paid to Eve during the twelve (12) months preceding the claim, whichever is lower.

10. GOVERNING LAW AND JURISDICTION

If you are a resident of the United Kingdom, these Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales, and any legal proceedings may be brought in the courts of England and Wales.

10.2 International Users

For users residing outside the UK, these Terms shall be governed by Swedish law, and any disputes shall be settled by a Swedish court, with the Stockholm District Court (Stockholms tingsrätt) as the court of first instance.
